Chaired by Kelly Canavan, the department provides hands-on legal representation in all aspects of real estate transactions and development, including negotiating purchases, sales, construction, and financing, obtaining the appropriate zoning and other regulatory approvals, and putting the necessary agreements in place with lenders, general contractors, construction managers, and subcontractors.
Sales and Acquisitions
We have significant experience representing our clients’ interests in a variety of real estate transactions from the initial contract through closing. Our experience also includes forward and reverse 1031 exchanges, as well as preparing all types of agreements relating to real estate transactions.
Leasing and Economic Development
Our real estate attorneys regularly handle leasing matters for our clients, which include both lessors and lessees. We prepare and negotiate a broad range of commercial leases for both large and small companies for shopping centers, commercial buildings, and industrial and residential properties, and work with local economic development agencies to help our clients obtain incentives.
Land Use and Zoning
The firm represents clients before Zoning Boards of Appeal, Planning Boards, and Town or Village Boards with regard to subdivisions, variances, and special use permits, and in court when challenges to land use and zoning approvals are the subject of Article 78 petitions.
The firm provides a full range of legal services to commercial and residential landlords and tenants, both public and private, in areas such as leasing and subleasing, regulatory compliance, and insurance coverage. We handle matters relating to nonpayment of rent, rent collection, lease violations, security deposits, habitability issues, repairs and maintenance, common area maintenance and other charges, nuisance and lease options, and renewals. The firm also represents condominium and co-op boards on a variety of compliance and transactional matters throughout Long Island, New York City, and New York State.
Our Long Island real estate attorneys are experienced in drafting and negotiating all types of construction contracts for clients on all sides of the table including owners, developers, general contractors, subcontractors, engineers, architects, and construction managers.
Banking and Finance
Our real estate practice includes the representation of local, regional, and national banks, institutional investors, and insurance companies. We work with clients on all aspects of due diligence when evaluating loans and financial transactions. We address client issues pertaining to commercial lending, protection of collateral, structured financing, and disposition of properties and assets. Our team is also experienced in handling loan workouts, creditor rights issues, and litigation if the need arises.
Our tax certiorari attorneys focus on obtaining tax relief for individual and corporate owners of residential, commercial, and industrial property. We handle challenges to real estate tax assessments from the routine to the complex throughout Long Island and the New York metropolitan area, bolstered by our relationships and experience with municipalities throughout the region. We also draw on the multidimensional resources of the firm for related issues that can arise in the tax certiorari arena, including land use matters and litigation.
