Because environmental, zoning, and land use issues are so frequently intertwined, CMM has formed the Environmental & Land Use practice group, chaired by Fred Eisenbud, to help our clients overcome any such problem.  As trusted advisors to individuals and community groups as well as industrial, commercial, residential, and municipal entities, our team has the legal skills, in-depth experience, regulatory relationships, technical understanding, and comprehensive knowledge to address our clients’ environmental, land use, regulatory, and compliance needs.  The practice spans criminal, civil, and administrative litigation, trial and appellate work, and private and public advocacy for clients throughout Long Island, New York City, and the Hudson Valley.

Representative Matters

Environmental Litigation and Appeals
Our experienced attorneys help clients efficiently and effectively resolve environmental and related legal disputes.  We handle civil cost recovery litigation, State Environmental Quality Review Act (SEQRA) issues, challenges to administrative and municipal determinations via Article 78 petitions, and insurance claims.  Our attorneys also represent clients charged with environmental crimes and handle appeals of all environmental law related matters.

Brownfields and Environmental Cleanup
We assist potential purchasers of contaminated Brownfield sites to resolve various environmental law challenges in commercial real estate transactions, including Brownfields applications, environmental cleanup, preparing and recording environmental easements, and handling insurance claims arising from contaminated properties.

Administrative Violations
We defend clients charged with federal, state, and local administrative violations, and we also assist clients in navigating and overcoming roadblocks that can arise during the environmental permitting process.

Land Use and Zoning
The firm represents clients regularly before Zoning Boards of Appeal, Planning Boards, and Town or Village Boards with regard to subdivisions, variances, environmental easements, and special use permits, and in court when challenges to land use and zoning approvals are the subject of Article 78 petitions.  We also assist clients with issues relating to SEQRA determinations, including preparation of a proper environmental impact study when required.
