Our firm is dedicated to protecting your innovation. Headed by Eryn Truong, our Intellectual Property group focuses on properly documenting, protecting, and enforcing our clients’ valuable intellectual property including trademarks, copyrights, and patents. We also work to protect our clients from infringement claims and avoid allegations of infringement. Our clients range from small startups seeking to register their first trademark to worldwide corporations with multinational IP portfolios and enforcement needs.
Registration of Trademarks, Copyrights, and Patents
Our experienced Intellectual Property attorneys are well versed in all phases of domestic and international trademark prosecution and registration, including conducting initial trademark clearances, preparing applications, and successfully responding to refusals from the U.S. Patent and Trademark Office (USPTO). We have successfully registered trademarks, including word and design marks, across a variety of industries for a wide range of goods and services. Our work also includes registration of copyrights and counseling clients on the patent application process.
Intellectual Property Portfolio Analysis and Management
The firm works with clients to develop comprehensive strategies for protection and management of IP assets. We review intellectual property portfolios, offer audit, due diligence, and anti-counterfeit services, and conduct asset evaluations and analysis. We advise clients on establishing best practices and procedures for IP protection and management in the areas of trademark, copyright, patent, trade dress, and trade secrets. Our team is highly experienced in drafting and responding to cease-and-desist letters following a thorough analysis of our clients’ rights.
Intellectual Property Transactions
The firm is experienced in high-level transactions based on intellectual property rights or involving an IP component, including mergers and acquisitions and technology licensing. We draft and negotiate IP-related agreements including independent contractor, work-for-hire, non-compete, nondisclosure, non-solicitation, and non-circumvention agreements. We also have experience related to Internet, web development, and web hosting matters, as well as many other types of complex technology contracts, including original equipment manufacturer (OEM), service level agreements (SLA), software as a service (SAAS), and application service provider agreements (ASP). Our attorneys also regularly advise clients on cybersquatting and domain name issues.
Intellectual Property Litigation
Our Long Island Intellectual Property attorneys have litigated contentious high-stakes disputes from both sides on matters involving trademarks, copyrights, and patents. We have handled matters pertaining to IP agreements, misappropriation of trade secrets, and unfair competition in multiple jurisdictions on both coasts in federal and state courts, including the highly respected Delaware Court of Chancery. We also enforce and defend trademark rights in opposition and cancelation proceedings before the Trademark Trial and Appeal Board (TTAB) of the USPTO and in domain name administrative proceedings under the Uniform Domain Name Dispute Resolution Policy (UDRP). Our team is also proficient in resolving disputes through alternative dispute resolution, such as arbitration and meditation.
