An experienced litigator, Joseph K. Poe represents clients in complex commercial litigation, environmental matters, and insurance coverage litigation in state and federal court.

Joe’s commercial litigation practice focuses on the representation of clients in lawsuits alleging breach of contract, tortious interference, and violation of intellectual property rights, as well as shareholder derivative lawsuits and dissolution disputes.  He represents clients in environmental matters including civil cost recovery litigation, administrative violations, and municipal disputes.  His diverse experience includes the successful defense and settlement negotiation in the Ephedra Multi-District Litigation, the defense of a school bus company against an Article 78 proceeding challenging the award of a district contract, and the representation of a technology company in a dispute regarding the creation of a website and related intellectual property issues.  Joe has also prosecuted violations of the New York Civil Rights Law and the New York Public Health Law, and has argued numerous motions and appeals in state and federal court.

Joe’s practice also includes significant insurance coverage litigation matters.  He successfully represented insurance company clients in liability insurance disputes concerning coverage for wrongful death and personal injury lawsuits arising out of the September 11 tragedy.  He also achieved favorable settlements in disputes concerning coverage for the policyholder’s remediation of Superfund sites in Indiana and Ohio.  Joe has advised insurers regarding their coverage obligations in areas including commercial general liability, pollution liability, homeowners and automobile liability, and first-party property insurance.  He has performed extensive insurance analyses and drafted coverage position letters in a variety of jurisdictions, and is also experienced in resolving insurance matters including ERISA, environmental, and intellectual property claims through alternative dispute resolution.
